Welcome to Ohana, a commission-free online ordering and growth platform operated by Ohana Tech, Inc. These Terms of Service (“Terms”) govern your access to and use of our services, including our website-building tools, hosting infrastructure, integrations, and support (collectively, the “Services”).By signing up or using the Services, you agree to be bound by these Terms.

Who We Are

Ohana is a Software-as-a-Service (SaaS) platform by Ohana Tech, Inc. that enables restaurants to launch and manage branded websites. Our Services include online ordering integrations, customer loyalty tools, SMS/email marketing support, and third-party service coordination.

Eligibility and Account Registration

You must be a legal representative of a business to register. You agree to provide accurate information and maintain the security of your login credentials.

Subscription and Billing

Subscription Term: Month-to-month, renewing automatically.
Cancellation: Cancel anytime without penalty via your account dashboard or by written notice.
Fees: Billed monthly in advance. All fees are non-refundable.
Third-Party Fees: You are responsible for fees from Stripe, Uber, or other third-party integrations.

Use of Services

You may use our Services solely for operating a restaurant-related business. You agree not to:
Resell or sublicense the platform.
Use the Services for unlawful or harmful content.
Interfere with system security or operation.

Content and Intellectual Property

You retain ownership of all restaurant-specific content (e.g., menus, branding, images).
Ohana Tech, Inc. retains all rights to platform code, infrastructure, and templates.
You grant us a limited license to use your content solely for providing and improving the Services.

Data and Privacy

We process customer and operational data per our Privacy Policy. If you collect data from end-users, you are the controller and responsible for your own privacy disclosures.

Termination

You may cancel at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or misuse the Services.

Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where feasible.

Disclaimers and Limitation of Liability

Services are provided “as-is” without warranties. O Tech, Inc. is not liable for indirect, incidental, or consequential damages. Our maximum liability is limited to one month of subscription fees.

Changes to Terms

We may modify these Terms with 30 days’ notice. Continued use of the Services after changes means you accept the updated Terms.
